Client Rights

Service Limitations

Our services are provided on an "as is" basis. While we strive for accuracy and quality in our platform evaluations and recommendations, we cannot guarantee specific outcomes or results from implementing our recommendations.

Liability Cap

In no event shall futurecrafter's total liability to you for all claims arising from or related to our services exceed the total amount paid by you to futurecrafter for the specific services giving rise to the claim.

Excluded Damages

futurecrafter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Lost profits or revenue
  • Business interruption
  • Loss of data or information
  • Cost of substitute services
  • Damages resulting from third-party platform failures or issues

Client Responsibility

You acknowledge that:

  • Final platform selection decisions remain your responsibility
  • Implementation of recommendations is at your own risk
  • You should conduct your own due diligence before making technology investments
  • Our recommendations are based on information available at the time of analysis

Indemnification

You agree to indemnify, defend, and hold harmless futurecrafter, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of our services in violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your implementation of our recommendations
  • Any false or misleading information you provide to us

Confidentiality

Both parties acknowledge that confidential information may be shared during the course of our business relationship. We agree to:

Governing Law

Before initiating formal legal proceedings, we encourage parties to attempt resolution through good faith negotiations. If direct negotiation fails, disputes may be submitted to mediation through a recognised Austrian mediation service.

Termination

These Terms remain in effect until terminated by either party. Termination may occur under the following circumstances:

You may stop using our services at any time. If you have ongoing service agreements, termination terms will be governed by those specific agreements.

Termination by futurecrafter

We may terminate your access to our services immediately if:

  • You breach these Terms or any service agreement
  • You fail to pay fees when due
  • Your use of services poses legal or security risks
  • We cease offering services (with reasonable notice)

Effect of Termination

Upon termination:

  • Your right to use our services ceases immediately
  • Outstanding fees become immediately due and payable
  • Confidentiality obligations survive termination
  • You retain rights to reports and deliverables already paid for

Force Majeure

futurecrafter shall not be liable for any delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour strikes, government actions, or technical failures of third-party systems.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.

Entire Agreement

These Terms, together with our Privacy Policy and any applicable service agreements, constitute the entire agreement between you and futurecrafter regarding the use of our website and services, superseding any prior agreements or understandings.

Amendments

We reserve the right to modify these Terms at any time. Material changes will be communicated through our website or direct notification to active clients. Continued use of our services after changes constitutes acceptance of the modified Terms.
